Protection for Commercial Tenants Not Paying Rent Extended

June 23, 2021

Category: News

With the recent Government announcement that existing measures to protect commercial tenants from eviction are to be extended to 25th March 2022, alongside the restriction on the use of the Commercial Rent Arrears Recovery (CRAR) process, we are continuing to support our clients as best we can.

An Alternative to CRAR – Recovering Unpaid Rent via the County Court

Over the last 12 months, we have managed to assist a number of commercial landlords, who have successfully obtained a County Court Judgment (CCJ) for rent arrears, by transferring the CCJ to the High Court for enforcement.

The most recent case involved rent arrears in excess of £47,000 from a business that was able to re-open during 2020 but had failed to pay its rent.

We were instructed to obtain a Writ of Control and the tenant made a substantial payment within 7 days, with agreement being reached for the remainder of the arrears.

If you act for or are a commercial landlord and require our help in acquiring a Writ of Control, please contact our team for further information.
