Government Sets Out Legislation for Eviction Protection and Taking Control of Goods

The Lord Chancellor has confirmed the Government will be laying a Statutory Instrument (SI) before Parliament today, to come into force on 17 November 2020, setting out new legislation for the industry over the winter period in England.

The SI covers prevention of evictions until 11 January 2021, with some exceptions for serious circumstances, and prohibits enforcement agents from taking control of goods inside residential properties whilst national health protection regulations are in force.

However, this measure doesn’t include taking control of goods at businesses and enforcement officers can still take steps to recover monies owed using other avenues, such as telephone, visiting but not entering residential properties, and taking control of goods outside of the home or on the highway.
